General Terms and Conditions of Sale and Use (GTCU)

Who are we?

ALFAMA CHIC, LDA (” ALFAMA CHIC”, ” nous “, ” notre “), ” Sociedade por Quotas “, with a share capital of 20,000.00 EUR (twenty thousand Euros), whose registered office is located at Rua de Vera Cruz nº13 3º andar AP 39, 2780-306 OeirasPortugal and holder of legal entity identification and registration number 517276895.

 

Thank you for taking a few minutes to read our General Terms and Conditions of Sale and Use (GTCSU) for the www.alfamachic.com website (” Site “) published by ALFAMA CHIC.

 

These GTCU contain important information for you as a user of our Site and purchaser of our products, and apply to all products used or purchased on our Site.

Applicability of the GCU

1.      Your use of this Site, any related subdomains and all related services, products, offers, deliveries and services is expressly subject to your acceptance of these TOU. By using our Site, purchasing products or taking advantage of any of our services, the customer (” customer ” or ” customer “) automatically accepts and abides, without reservation or exception, by these GTCU, including any future modifications announced by publication on our Site or notified in any other way.

2.      ALFAMA CHIC reserves the right to modify the GTCU at any time without prior notice. The modified GTCU will be applicable as soon as they are made available on the Site page, without any further formality being required. The customer will be deemed to have accepted the new GTCU. For this reason, customers are invited to consult the GTCU on a regular basis.

3.      If you do not agree with these terms and conditions, you may not use or access our Site, use our services or purchase our products. No inconsistency in the interpretation of these GCU can be held against ALFAMA CHIC.

 

 

Intellectual property

1.      All content published on the Site (including logos, trademarks, copyrights, etc.) is the exclusive intellectual property of ALFAMA CHIC and, without the express authorization of ALFAMA CHIC, may not be distributed, modified or used in any way whatsoever. Any reproduction, distribution, commercialization or transformation of the contents that has not been expressly authorized by their owners constitutes a violation of intellectual and industrial property rights protected by law. ALFAMA CHIC may take all competent administrative, civil or criminal action in the event of violation of these rights by the customer.

2.      Access to and use of the Site and its services, in particular the creation of a personal account by the customer, does not entail any transfer of ownership on any grounds whatsoever.

 

Site content

1.      On the Site, the customer can purchase products from the ALFAMA CHIC company. On the Site, the customer can access a description of the essential characteristics of the products and the concept behind their development.

2.      On the Site, the customer can : (i) consult and order ALFAMA CHIC products and their composition/description; (ii) create, access, update or delete information within your personal account; and (iii) track orders and manage orders under the ALFAMA CHIC product subscription ordering modality.

3.      These services are only available in French, Portuguese, English and Spanish.

 

Terms of use

1.      By using the Site and accepting these GTCU, you declare that, in your country of residence, you are of legal age and that the purchase and use of our products or services are legal in your place of residence or product destination. It is the sole responsibility of the customer to ensure compliance with the law, and ALFAMA CHIC has no responsibility in this regard.

2.      ALFAMA CHIC ensures that all content and services offered on the Site respect the principle of the dignity of the person, the principle of non-discrimination on the grounds of race, sex, religion, opinion, nationality, disability or any other personal or social data, as well as the principle of the protection of youth and childhood.

3.      The customer undertakes to make proper use of the Site’s content and services, which may never be used for activities that are illicit or contrary to public order, national defense or public health. Any use of content and services by the customer must comply with the principles set out in the previous paragraph.

4.      The customer is expressly authorized to view all the information contained on the Site, as well as to make private reproductions thereof on his operational systems, provided that these contents are intended for his exclusive use and are not subsequently transferred to third parties.

 

General information and products & services

1.      All information appearing on the Site and on any other written document issued by ALFAMA CHIC has been prepared with the utmost care and attention. However, ALFAMA CHIC cannot guarantee that all information is correct, complete and/or up-to-date. ALFAMA CHIC reserves the right to modify any information on the Site or in any other written document without prior notice. It is your responsibility to check all information in case of change.

2.      ALFAMA CHIC reserves the right, at any time and without accepting any responsibility from the customer or third parties, to modify the products and services offered, and to withdraw products and services from its catalog.

3.      On the Site, ALFAMA CHIC may occasionally offer discounts on products and services. We reserve the right to modify, restrict or withdraw any offer at our sole discretion.

4.      We reserve the right, at any time and without justification, to restrict or discontinue entirely the sale of products or the provision of services to an individual customer, to any other person, in specific countries or regions.

5.      Any decision you make regarding the use of our products and services based on the information offered by ALFAMA CHIC on the Site is your personal responsibility and must be taken at your own risk.

6.      We cannot guarantee that our Site and services will be error-free and provided on an uninterrupted basis. ALFAMA CHIC regularly carries out maintenance and development work on its Site in order to ensure its updating and proper functioning. ALFAMA CHIC reserves the right to remove functionalities and/or options as part of these evolutions and updates. ALFAMA CHIC is in no way responsible for any difficulty in accessing or using the services resulting from updates and developments. In the event of loss of service or disruption, you can contact ALFAMA CHIC to try and find a viable solution.

 

Registration, customer account and personal data

1.      Access to the Site is free of charge. To place an order on the Site, the customer must create a personal account. During the registration process, an identifier is automatically generated for the customer, based on his/her name or e-mail address, and a link is sent to the new user to define his/her password. ALFAMA CHIC is not responsible for the misuse of registration information and considers the person using the Site to be the registered customer.

2.      Order tracking is handled by sms and e-mail, but can also be handled by e-mail and telephone. Order management is handled from the customer’s account AND can also be handled by e-mail AND/OR telephone.

3.      To create an account, the customer must provide the following information : (i) surname and first name ; (ii) e-mail address ; (iii) telephone number ; (iv) date of birth ; (v) delivery address ; (vi) billing address.

4.      ALFAMA CHIC and its staff will never ask the customer for his password. If you believe that your registration information has fallen into the wrong hands, you must notify ALFAMA CHIC immediately by telephone on +351913812341 or by email. hello@alfamachic.com .

5.      Customers must ensure that their account information is correct and up-to-date. The customer acknowledges that the provision of any information that is erroneous, incomplete, misleading or does not comply with legal or regulatory requirements is likely to engage his responsibility both towards third parties and towards ALFAMA CHIC to whom this information would cause harm.

6.      ALFAMA CHIC reserves the right to delete, without prior notice, any personal account that does not comply with the GCU and in particular that contains false, inaccurate or incomplete information.

7.      The customer may at any time request deletion by contacting ALFAMA CHIC by email hello@alfamachic.com . The request is then processed as quickly as possible.

8.      All personal data of customers are treated and protected by ALFAMA CHIC as described in our Privacy Policy, which is an integral part of our GTCU. For more information, please read our privacy policy.

 

Orders and contracts

1.      To order our products, the customer must be at least eighteen years old, have full legal capacity or be the holder of a parental authorization allowing him to place an order.

2.      All orders are subject to acceptance and availability. The mere presentation of products on the Site cannot be interpreted as a guarantee that ALFAMA CHIC will conclude a contract of purchase and sale. As products are not necessarily always available in stock, it is not possible to conclude a purchase and sale contract immediately after the customer has submitted an order.

3.      While we make every effort to ensure the accuracy of all information and specifications contained on our Site or in other written materials, errors and omissions may still occur. We reserve the right to make any corrections we deem necessary and to update or cancel any order that may be affected by such corrections.

4.      With the submission of the order by the customer, the conditions of the latter bind ALFAMA CHIC for a period of seven 7 working days.

5.      The mere submission of an order by the customer to ALFAMA CHIC does not constitute a contract. ALFAMA CHIC has five (5) days to confirm the order. You acknowledge that any automatic acknowledgement of receipt of your order that you may receive from us shall not constitute our acceptance of your order. A contract between you and ALFAMA CHIC will be formed when (i) payment for the product or service is debited to ALFAMA CHIC in the agreed manner; and (ii) we send you the products.

6.      Any modification of the order by the customer after the order has been placed must be confirmed by ALFAMA CHIC and is subject to acceptance by ALFAMA CHIC. Changes to orders prior to shipment can be requested by contacting customer service, but cannot be guaranteed.

7.      ALFAMA CHIC reserves the right to partially or totally reject an order without specifying the reasons.

8.      In case of cancellation, restriction or suspension of an order, ALFAMA CHIC will inform you by e-mail and you will have the opportunity to wait until the item is available in stock or to cancel your order.

9.      Once the order has been placed, the customer still has the legal right of withdrawal, in accordance with the provisions of the French Consumer Code.

 

Prices and payment terms

1.      All prices indicated by ALFAMA CHIC on the Site and in other written documents issued by ALFAMA CHIC include VAT at the legal rate. All orders are payable in euros. All costs included in the price are clearly specified. Additional costs may arise, which will be indicated separately and must be paid by the customer.

2.      ALFAMA CHIC reserves the right to change prices at any time without notice.

3.      The customer is responsible for any payments and customs duties. ALFAMA CHIC has no influence on these additional costs and can make no representation as to their amount. For further information, please contact the destination customs authorities.

4.      The purchase price must be paid immediately by the customer, and the purchase and sale contract is concluded with the verification of its correct collection. Until the full purchase price is received by ALFAMA CHIC, the products will not be shipped or delivered to the customer. In the event of late payment, and in the absence of an extension of time communicated by ALFAMA CHIC, ALFAMA CHIC may cancel the order.

5.      The methods of payment accepted are specified on the Site. We reserve the right to change these payment methods at any time, at our discretion.

6.      To the best of our ability, we take all reasonable precautions to ensure the security of your order and payment details. In the absence of negligence on our part, we cannot be held responsible for any loss you may suffer if a third party obtains unauthorized access to any data provided by you when accessing or ordering from the Site. The customer confirms that the credit or debit account used is his/her own. All credit/debit cardholders and other payment methods accepted on the Site are subject to validation and authorization checks by the payment processor. If the issuer of your payment card or the operator of your alternative payment method refuses or does not authorize us, for any reason whatsoever, to collect the sums due, we cannot be held responsible for any delay or failure to deliver.

7.      The products sold on the Site are not intended for resale or distribution. We reserve the right to cancel orders and/or suspend accounts if we consider that products are ordered in violation of this provision.

 

Delivery

1.      Products will be delivered to the delivery address you indicated at the time of purchase within 5 to 20 working days, when the product is available. Delivery times vary according to destination country. Please refer to the Site for further information. All terms of delivery are non-binding and failure to comply with them does not entitle you to withdraw from the contract.

2.      At the time of delivery, the customer undertakes to check the conformity and condition of the packaging of the product(s) ordered, as well as the conformity of the product(s) ordered in relation to the invoice.

3.      If ALFAMA CHIC is late in delivering your order, you must first wait a minimum of 30 days, during which we can still execute the contract before you can cancel it. In the event of cancellation of the contract, ALFAMA CHIC will not refund more than the purchase price. The obligation to pay higher compensation for late or missed delivery is excluded.

4.      The customer must accept partial delivery if, for example, part of the products purchased is not available or can only be delivered at a later date.

5.      Benefits and risks are transferred to the customer upon shipment of the products. ALFAMA CHIC will not be responsible for loss or damage to products during transport.

6.      The customer expressly declares and acknowledges that he/she is a resident of one of the countries to which ALFAMA CHIC offers delivery of its products. The customer may not place an order on behalf of a third party. The customer undertakes not to make the products available in any form whatsoever on the markets of the countries affected by the unavailability of delivery.

7.      We accept no responsibility if you provide an incorrect delivery address or if you do not collect the products from the delivery address you have provided.

 

Legal warranty of conformity and right of return and exchange

1.      The legal warranty on ALFAMA CHIC products is 3 years.

2.      Once you have received the products, you must inspect them and inform ALFAMA CHIC of any defects within 7 days, otherwise the products will be considered approved. The customer will have to formulate reserves by contacting the customer service.

3.      Defective products must be returned to ALFAMA CHIC for inspection at the address indicated on the website with the order number, a copy of the invoice and a description of the problem. Shipping costs to our address are your responsibility, unless we or the carrier are responsible for the return or exchange. An exchange or refund will only be made after we have checked the condition of the product.

4.      The customer may choose between reimbursement or replacement of the item, unless the item is no longer available or the cost of replacement is clearly disproportionate to the value of the item or the extent of the defect. ALFAMA CHIC will then be obliged to proceed, unless this is impossible, according to the method chosen by the customer.

5.      Cancellation of an order is only possible if payment has not yet been made and the order has not yet been processed.

 

Right of withdrawal

1.      In accordance with the provisions of European Directive 2011/83/EU of October 25, 2011 on consumer rights, the customer has a period of fourteen days from receipt of the product(s) ordered to inform ALFAMA CHIC of his desire to exercise his right of free withdrawal.

2.      The right of free retraction must be notified by email using the retraction form which you can access  here .

3.      The customer must return the product(s) no later than fourteen days following the date of communication of his decision to withdraw. The withdrawal period runs from the date on which the customer (or a third party designated by the customer and who is not the carrier) takes possession of the product(s). If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

4.      ALFAMA CHIC undertakes to reimburse the customer for all payments received for the product(s) subject to retraction (except for delivery costs and additional costs, resulting from the choice of a more expensive delivery method than the standard method offered, taxes and customs duties possibly paid by the customer) without excessive delay and at the latest within fourteen days following notification of the customer’s right of retraction.

5.      Refunds are made by the same means of payment as the one initially used. ALFAMA CHIC may defer reimbursement until recovery of the products or receipt of proof of reshipment, whichever is later.

 

Exclusion of liability

1.      To the fullest extent permitted by law, all liability of ALFAMA CHIC is excluded for any loss or other damage suffered by the customer on the basis of or in connection with the conclusion of a contract for the purchase, delivery or use of ALFAMA CHIC products and services.

2.      The customer accepts that the use of products and services offered by ALFAMA CHIC is at his own risk.

3.      The customer may not make a claim if the defect was caused by misuse or accident for which he is responsible, or if he knew of the defect before purchasing and accepting the product.

4.      Delays, poor execution or total or partial non-execution of orders resulting from cases of force majeure, including but not limited to fire, flood, strikes, regulations or requirements of the public force, or any other unavoidable, unforeseeable event beyond the control of ALFAMA CHIC may not give rise to compensation. The provisions of the present article shall in no case, however, release either party from the obligation to pay the other any sum due.

Applicable law and jurisdiction

1.      The contractual relationship between ALFAMA CHIC and the customer under these GTCU is subject to Portuguese substantive law, unless the rules of the law of the customer’s country of residence, with respect to the specific application of a provision, are more favorable or such rules are mandatory under the law of the customer’s country of residence.

2.      Any legal or arbitral dispute arising out of or in connection with the contractual relationship between ALFAMA CHIC and the customer under these GCSU, if brought by the customer, may be submitted to the Portuguese courts or to the courts of the customer’s country of residence. If the dispute is brought by ALFAMA CHIC, it will be submitted to the court of the customer’s country of residence.
